Pharmacy Has to Pay After Misgendering a Customer

Defense argues that “humans should be defined by biological sex,” but Tel Aviv court disagrees and rules that plaintiff was “defamed”

The “Woke” movement is alive and well in Israel and is increasingly becoming the law of the land, as evidenced by a Tel Aviv Magistrate’s Court ruling last week.

Globes reports that the court ordered Israeli supermarket chain Shufersal to pay damages in the amount of $10,000 (over 30,000 shekels) after one of its pharmacists misgendered a customer.

The incident occurred in August of 2018, when a customer by the name of Isabel insisted, according to the lawsuit, that the pharmacist in question refer to her as a woman. Instead, the pharmacist continued to use the male-gendered form of Hebrew words.

The pharmacist, who is a biological female, told the court that she knew the customer was a man “because of their voice.”

A transcript of the interaction revealed that the pharmacist’s manager entered the fray and took Isabel’s side, but the pharmacist persisted in referring to the customer in male-gendered speech.

Shufersal’s lawyers argued that the case should be thrown out because biologically Isabel is a man, and “humans should be defined by their biological sex.” As such, something that is technically true can’t be construed as slander.

The court however ruled that the pharmacist’s actions constituted “defamation,” with the judge concluding: “Isabel left no room for doubt regarding her desire to be addressed as a woman, as well as the harm experienced due to the pharmacist’s insistence on addressing her as a man.”
