ANALYSIS: Israel and the genocide case against Iran at the ICJ

Israel has a much stronger case to make at the ICJ than what South Africa brought against it, and cabinet ministers are pushing for it.

Israel is strongly considering suing Iran at the International Court of Justice (ICJ) in The Hague, Minister-Without-Portfolio Gideon Sa’ar announced on Monday.

This is because of open Iranian violations of the Genocide Conventions, which involve calling for genocide and helping to carry it out.

After consultation with Tzachi Hanegbi, Israel’s national security advisor, Sa’ar decided to submit a concrete proposal to Prime Minister Benjamin Netanyahu, who ultimately will decide whether or not to go to the ICJ.

Considering Netanyahu’s long record of warnings against the existential danger that Iran poses to the Israeli people, he will agree to the plan and that will mean that Israel will turn the tables at the ICJ.

Instead of being in the dock for a false accusation of genocide in Gaza, Israel will lead the charge against Iran on the same issue.

The irony is that a year ago Israel would have had no chance of indicting Iran at the ICJ because Iran only signed a statement in June last year committing itself to recognize the jurisdiction of the International Court of Justice in any case against the Islamic Republic.

The question now is whether Israel will be able to provide enough evidence against Iran to get the court to hear the case.

When we look at the provisions on calling for genocide in the Genocide Conventions, there is plenty of evidence as Iranian leaders, including Ayatollah Ali Khamenei, repeatedly say that Israel should be wiped off the map or exterminated, depending on the translation from Farsi.

Israel was further called a “cancer” that needs to be removed from the Middle East because Israel is the only non-Muslim state on the territory of ‘Dar al-Islam,’ the territory of Islam that once extended into Spain.

Khamenei has even spoken, following the Nazis (entlösung), about a “final solution” to what he sees as the problem of the Zionist entity.

In May 2020, Khamenei published a poster on his official website in which a text mentioned the need for a “final solution” to the Jewish state.

The Iranian leader later tried, after a storm of protests, to limit the damage by claiming that he had meant the removal of the “Zionist regime,” and not the Jews.

This is about the “elimination of Israel,” he added in his explanation, in which he also admitted that Iran “will support any group or nation that fights against the “Zionist regime.” The poster featured an edited photo showing a crowd celebrating on the Temple Mount after Israel’s hoped-for destruction.

A more recent example of Iran’s genocidal intent against Israel was a large billboard that appeared on the streets of Tehran at the end of January.

On the billboard that was hung on an Islamic Revolutionary Guards Corps building in Tehran, ballistic missile is visible and the text in Hebrew: Shelters? Prepare the coffins for your funeral!

These are just two examples in a long line of calls for genocide and the destruction of Israel that Iran is now trying to put into action.

In his explanation of his plan to indict Iran in connection with genocide, Sa’ar also talked about Iran’s role in the violent actions of terrorist movements and militias that are now fighting Israel on six fronts.

These fronts are Gaza, Judea and Samaria, Lebanon, Syria, Iraq and Yemen, where Ansar Allah (the Houthis) has emerged as a dangerous and fanatical enemy of Israel since the Hamas genocide on October 7.

There is ample evidence that Iran is arming, training and financing these terrorist movements after, for example, the US Navy intercepted Iranian arms shipments in the Persian Gulf.

The Israeli navy also intercepted Iranian arms shipments in the Red Sea and captured small containers with missiles off the coast of Gaza that came from Iran.

The best example was the ship MV Karine A, which was en route to the Jordanian port city of Aqaba with weapons from Iran in January 2002. The weapons were intended for Yasser Arafat’s Palestinian Authority, which was at war with Israel at the time.

Other evidence includes the debris of rockets fired at Israeli population centers during the wars with Hamas and Hezbollah, which were produced in Iran.

The evidence regarding Iran’s role in attempting to implode Israel through relentless deadly terror and now a multi-front war has been reinforced by the current war against Hamas and Palestinian Islamic Jihad in Gaza.

During the turbulent events on October 7, terrorists and their accomplices gave orders in Farsi in Gaza, something that was not unique because the Iranian Islamic Revolutionary Guards always has ‘advisers’ on the ground in the areas where Iran’s proxies are waging war.

Assassinated commander of the IRGC’s Quds Force Qassem Soleimani even personally oversaw many battles fought by these proxies against ISIS in both Syria and Iraq.

The clearest evidence of Iranian involvement in 10/7 came from the documents found on the bodies of slain terrorists on and after October 7.

These documents came into the possession of Ryan McBeth, an American expert on military operational plans who analyzed the operational plans found by the IDF and concluded that they could only have been drawn up by a state, and said that it is highly probable that these operational plans were made in Iran.

McBeth received help in analyzing the documents from people who speak Arabic as their mother tongue.

The entire execution of the actions of Hamas and other terrorists on October 7 had the hallmarks of an Iranian operation.

It was something completely different than what Hamas had ever done against Israel, and we’re not talking about the terror.

The planning of the start of the operation already showed that this was of a different caliber than, for example, the ‘great march of return’ that Hamas organized every week along the border with Israel. No incendiary balloons or Molotov cocktails, but cyber attacks, attacks with unmanned aircraft, and a very well-organized plan, according to McBeth.

Moreover, detailed maps of IDF bases have also been found that were based on satellite photos. Hamas has no satellites in space, but Iran does.

By now AMAN, the IDF intelligence service, must have all the evidence against Iran’s involvement in the genocide on October 7 that was found right after the massacre and during the ground operation in Gaza.

This evidence makes Iran complicit in the genocide carried out on October 7, 2023 against Israeli Jews in the villages around Gaza.

The case that Israel will bring against Iran at the ICJ therefore appears to be a lot stronger than that of South Africa against the Jewish state.

    Don’t miss a trick. The international community are supportive of Iran’s genocidal designs against Israel. Cite the work of UN agencies like UNRWA; Multiple UN resolutions against Israel despite other nations being guilty of gross violations of law and human rights; The lax enforcement of Resolution 1701 and others and The rejection of Judeo-Christian values in many countries.
