ICC dismisses Israel’s appeal against arrest warrants for Netanyahu, Gallant

Even as its top prosecutor faces misconduct allegations, The Hague doubles down on its war-crimes case against the leaders of the only democracy fighting Hamas.

The International Criminal Court has formally rejected Israel’s appeal against arrest warrants issued for Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant—signaling once again that, in The Hague, political theatrics now carry more weight than legal standards.

The decision, issued Friday, brushed aside Israel’s May request that the ICC halt its warrant process while judges deliberate a broader challenge to the court’s jurisdiction. Israel, notably, is not a signatory to the Rome Statute, and therefore not legally subject to the ICC’s claimed authority.

But the court ruled that “the issue, as framed by Israel, is not an appealable issue,” according to AFP.

The warrants in question, requested earlier this year by ICC chief prosecutor Karim Khan, accuse Netanyahu and Gallant of using starvation as a weapon and deliberately targeting civilians during Israel’s war against Hamas in Gaza. But those charges remain entirely unmoored from the facts.

“Israel has let in more than two million tons of aid into Gaza,” Netanyahu said recently, noting that much of it was stolen by Hamas. “That’s one ton of aid per person.” He also pointed out the unprecedented steps the IDF has taken to warn civilians of incoming strikes—including millions of phone calls, texts, and leaflets.

In short: The ICC is prosecuting the only country on Earth that calls ahead before bombing a military target.

Meanwhile, the man behind the warrants—Karim Khan—has since taken a leave of absence amid a serious investigation into sexual misconduct, including allegations he pressured a victim not to come forward for fear it would damage his case against Israel.

Khan was previously sanctioned by the US for his role in targeting Israeli leadership. Two of the three judges who authorized the warrants were also hit with US sanctions in June. Those sanctions, according to reports, severely disrupted the court’s internal functioning.

And yet the arrest warrants remain.

“Now Khan has since been suspended,” Netanyahu said last month. “But his preposterous arrest warrants and his patently false charges against Israel have not been removed… They should be removed and removed immediately for justice and for truth to prevail.”

The ICC has not responded publicly to growing concerns about the credibility of its Gaza investigation or the internal integrity of its leadership. The broader question of whether the court even has jurisdiction over Israel remains unresolved.

Analysis: The Hague’s rulings are no longer anchored in law—they are weaponized symbols in a broader war of delegitimization. The fact that the prosecutor is under investigation while his politicized indictments stand untouched tells you everything about the court’s real agenda.

The ICC has forfeited its moral credibility.
